Terms and Conditions

These terms and conditions are the contract between you and Triniq (“us”, “we”, etc). By visiting or using Our Website, or signing up for our Services, you agree to be bound by them.

 If you violate these terms we may terminate your use of Our Website, bar you from future use of Our Website, cancel your Ticket order, and/or take appropriate legal action against you.

We are Triniq, a company registered in Australia, ABN number 33 641 387 911. Our address is Level 2/397 Riley Street, Surry Hills NSW 2010, Australia. If you need to contact us then please use email via support@triniq.com

You are: Anyone who uses Our Website or buys from us.

These are the agreed terms:

  1. Definitions

    “Content” means the textual, visual or aural content that is encountered as part of your experience on Our Website. It may include, among other things: text, images, sounds, videos and animations. It includes content posted by you.

    “Event” means an Event for which Tickets are offered for sale on Our Website.

    “Organiser” means a promoter, producer, performer or venue manager on whose behalf we sell Tickets.

    “Our Website” means any website or service designed for electronic access by mobile or fixed devices which is owned or operated by us or any member of the Triniq group of companies. It includes all web pages controlled by us.

    “Payment Gateway” means the payment processor account that takes the money from your bank and passes it directly to the beneficiary account (such as Stripe or PayPal).  The payment gateway and beneficiary account for majority of Events on our website is owned by the Organiser.  It is rare for us to accept your money directly with our own payment gateway account.  We will advise who owns the payment gateway account for an individual event upon request.

    “Post” means place on or into Our Website any Content or material of any sort by any means.

    “Ticket” means any ticket sold or offered for sale by us or an Organiser on Our Website.

    “Services” means a service available from Our Website, whether free or charged.

  2. Basis of Contract
    1. In entering into this contract you have not relied on any representation or information from any source except Our Website.
    2. You acknowledge that you understand exactly what is included in the price of a Ticket and you are satisfied that the Ticket you have selected is suitable and satisfactory for your requirements.
    3. Our contract with you is limited to our providing a platform for the purchase of Tickets. When you buy a Ticket through Our Website, you buy from the person who owns and operates that Event. We act as agents of that person ONLY to the extent of use of Our Website as platform to offer Services and for collection and forwarding of your money. When you purchase a Ticket, you do so subject to the terms and conditions which form your contract with that Organiser.
    4. We welcome your queries, any comment or complaint regarding your purchase, which you make through Our Website. We may act upon a complaint in our discretion, for the benefit of the body of Triniq members.
    5. We are not responsible to you further than to take your money and pass it to the Organiser.  If the Organiser has connected their own Payment Gateway to our website then the Organiser takes your money directly without it passing our bank accounts.   If requested we will tell you which payment gateway your money passes through for a specific event.
    6. In any dispute with an Organiser, you should deal only with the Organiser. We have neither legal obligation nor detailed information about the Event. 
    7. The Contract between us comes into existence only when we write to you to confirm that the Ticket you want is available. Your payment does not create a contract. If we decline to provide a Ticket we shall instruct the owner of the Payment Gateway to immediately return your money to your credit card.
    8. When you buy a Ticket through us, the price you pay includes our service charge.
    9. We may change this agreement and / or the way we provide a Ticket, at any time. If we do:
      1. the change will take effect when we post it on Our Website. You are advised to check this page from time to time.
      2. if you make any payment for Tickets or Services in the future, you will do so under the terms posted on Our Website at that time.
    10. When you buy a Ticket, in law you buy a personal licence to attend an Event. That license may be revoked at any time by the Organiser. If that happens you are entitled only to the return of money paid.
    11. To discourage unfair practices, we will not sell to you more than a maximum number of Tickets for an Event. That number varies from one Event to another and is specified on the page of Our Website describing that Event.
    12. We may restrict sales to a maximum number of Tickets per person, per group or per credit card. If you buy a number which we regard as excessive, we may cancel some or all of the Tickets. We may do this without notifying you. If you wish to know whether your proposed purchase will be accepted, you should contact us via Our Website.
    13. We do allow our ticket name changes for some events and tickets, however, if you are caught reselling the ticket unreasonably or unfairly, then we or the Organiser are entitled to cancel all your Tickets without compensating you.  If a ticket name change is not available for a particular event then our Website will prevent you from changing the name of that ticket.
  3. Organisers’ standard terms

    Each Ticket is issued subject to the terms and conditions of the Organiser. Full details are available on the Event website or at the venue box office. The terms of your contract with an Organiser may be less restrictive than those provided in this paragraph, but for the sake of good order, unless the standard terms of an Organiser specifically suggest otherwise, you agree that you buy a Ticket subject as follows:

    1. Breach of these terms and conditions will entitle the Organiser to cancel your licence to attend the Event. You may then be ejected from the Event venue. You may also be ejected from the venue for unacceptable behaviour.
    2. We operate under the terms and instructions of an Organiser. We may not exchange a Ticket, nor refund money for a Ticket which has been lost, stolen, damaged or destroyed. When you receive your Tickets, keep them safely.
    3. If you wish to combine one or more Tickets with the provisions of other services such as hospitality or accommodation or transport and resell the services as a package, you may do so only with the written permission of the Organiser. This applies also to any other disposal of the package, for example as a promotion or reward.
    4. You may not use a Ticket for any commercial purpose without the permission of the Organiser.
    5. An Organiser may change a programme in circumstances beyond his reasonable control.
    6. If you fail a security search, you may not be allowed to attend. No money will be refunded.
    7. For seated events, the Organiser may reserve the right to provide an alternative seat to that numbered on your Ticket, provided it was previously offered for sale at the same or a higher price that the one you bought.
    8. There will be no pass-outs or re-admissions for any reason.
    9. You must not use photographic or recording equipment without prior consent from Organiser written. If you do, you accept that the media on which they are made or recorded, may be destroyed.
    10. At some venues you may not bring in: laser pens, mobile phones, dogs (except guide dogs). Your own food and drink is also usually prohibited.
    11. Neither an Organiser nor we accept responsibility of your personal property.
  4. Your account and personal information
    1. When you visit Our Website, you accept responsibility for any action done by any person in your name or under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.
    2. You agree that you have provided accurate, up to date, and complete information about you. We are not responsible for any error made as a result of such information being inaccurate.
    3. You agree to notify us of any changes in your information immediately it occurs. If you do not do so, we may terminate your account.
  5. The price, payment and delivery
    1. The price payable for a Ticket is clearly set out on Our Website. Prices are inclusive of any applicable goods and services tax or other sales tax.
    2. We do not control the stock of unsold Tickets. We are sometimes one of several distribution points.
    3. Your Tickets will be delivered by your electronic download. Full instructions appear on Our Website as part of the buying process.
    4. We advise you to check your Tickets immediately on receipt, whether delivered by download or in hard copy.
    5. You are required to pay in the currency in which the Ticket is listed for sale on Our Website.
    6. Every sale will be subject to the laws applicable but there shall not be implied any right which is neither a legal right nor set down in these terms and conditions.
  6. Security of your credit card

    We take care to make Our Website safe for you to use.

    1. Card payments are not processed on a page controlled by us. We use one or more online payment service providers who will encrypt your card or bank account details in a secure environment.
    2. If you have asked us to remember your credit card details in readiness for your next purchase or subscription, we will securely store your payment details on our systems. These details will be fully encrypted and only used to process your automatic monthly payments or other transactions which you have initiated.
  7. Cancellations and returns: Ticket terms
    1. If you anticipate the possibility of some difficulty, we advise you to contact the event organiser before you buy.
    2. We cannot refund your money nor change an arrangement.  For all refund enquiries please contact the event Organiser.
    3. You accept that there may be pricing errors on Our Website. In the event of a serious under pricing error, we are not liable to provide Tickets to you. Your order will be cancelled and the owner of the Payment Gateway account will refund any money paid.
    4. We will not accept returns unless the Ticket delivered to you is not of the Event you ordered at the time of purchase, or we or the Organiser have agreed in correspondence that you may return it.
    5. If the Event takes place but you do not receive the Ticket you have purchased for any reason you will be able to enter the Event by presenting your license, passport or authorised photo identification that matches the full name on the Ticket.  
    6. Only the person named on the ticket can use their photo identification to claim entry of the Event.
    7. No duplicate hard copy Ticket will be issued to replace the original that has been lost or stolen after it has been delivered to you, nor will price of such Ticket be refunded.  Electronic Tickets can be downloaded again at any time prior to the event by logging into your account that you used to purchase the tickets with.
    8. Subject to the conditions mentioned in this paragraph, all monies paid by you to us or the Organiser are non-refundable.
  8. Change or postponement of an Event
    1. Before attending an Event, please check on the Event’s and Organisers website that an Event is going ahead at the scheduled date, time and venue.
    2. If an Event is cancelled or the Organiser make a significant change to the venue, date, show time or (concerts only) headline act, the Organiser will try to inform you. This will usually be by email or social media.
    3. We will try to help you if an Event is cancelled or changed. You may contact us for information relating to:
      1. general information;
      2. seats at any rescheduled Event (subject to availability) up to the face value of the Tickets;
      3. a full or partial money refund request, depending on the extent of the cancellation or change of Ticket and the owner of the Payment Gateway account.
    4. If an Event is rescheduled, changed or moved, we will give you the option of either retaining or exchanging the Ticket for the new date or location, or alternatively requesting a refund with the Organiser.
    5. If any significant change is made to any arrangement, and you do not wish to accept the change, we will help you request a refund with the Organiser.
    6. In any case, Triniq of the Organiser cannot be held responsible for any resulting costs you may incur for travel, accommodation, any other related goods or service or other compensation.
  9. Interruption to our Service
    1. If it is necessary for us to interrupt our Service, we will give you reasonable notice where this is possible and when we think the down time is such as to justify telling you.
    2. You acknowledge that our Service may also be interrupted for many reasons beyond our control.
    3. You agree that we are not liable to you for any loss, foreseeable or not, arising from any interruption to our service.
  10. Disclaimers and limitation of liability
    1. The law differs from one country to another. This paragraph applies so far as the applicable law allows.
    2. All implied conditions, warranties and terms are excluded from this agreement.
    3. Our Website includes Content posted by third parties. We are not responsible for any such posting. If you come across any Content which offends against this document, please contact us via the “Contact us” page on Our Website or by emailing support@triniq.com.
    4. You are advised that Content may include technical inaccuracies or typographical errors. This is inevitable in any large website. We would be grateful if you bring to our immediate attention, any that you find.
    5. We sell Tickets in good faith. But we make no representation or warranty that the Ticket nor Event will be:
      1. useful to you;
      2. of satisfactory quality;
      3. fit for a particular purpose;
      4. available or accessible, without interruption, or without error.
    6. Our Website contains links to other Internet websites. We have neither power nor control over any such website. You acknowledge and agree that we shall not be liable in any way for the content of any such linked website, nor for any loss or damage arising from your use of any such website.
    7. We claim no expert knowledge in any subject. We disclaim any obligation or liability to you arising directly or indirectly from information you take from Our Website or via our support emails.
    8. We accept no responsibility the happening of the Event. In the event of any problem, your contract is with the Organiser.
    9. You agree that in any circumstances when we may become liable to you, the limit of our liability is the amount you have paid us for your Ticket.  If you have paid the Organiser directly via their own Payment Gateway then we are not liable for any loss, you would need to contact the Organiser. We are not liable for any loss of enjoyment or wasted expenditure. Personal arrangements including travel, subsistence and accommodation relating to the Event which have been arranged by you are at your own risk.
    10. This paragraph (and any other paragraph which excludes or restricts our liability) applies to our directors, officers, employees, subcontractors, agents and affiliated companies as well as to us.
  11. Miscellaneous matters
    1. Our privacy policy is strong and precise. It complies fully with the current privacy law which is displayed on this page.
    2. If any term or provision of this agreement is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms.
    3. If you are in breach of any term of this agreement, we may:
      1. publish all text and Content relating to the claimed breach, including your name and email address and all correspondence between us and our respective advisers; and you now irrevocably give your consent to such publication.
      2. terminate your account and refuse access to Our Website;
      3. issue a claim in any court.
    4. Any obligation in this agreement intended to continue to have effect after termination or completion shall so continue.
    5. No failure or delay by any party to exercise any right, power or remedy will operate as a waiver of it nor indicate any intention to reduce that or any other right in the future.
    6. You agree that we may disclose your information including assigned IP numbers, account history, account use, etc. to any judicial or proper legal authority who makes a written request without further consent or notification to you.
    7. Any communication to be served on either of the parties by the other shall be delivered by hand or sent by express post or by e-mail. It shall be deemed to have been delivered:
      1. if delivered by hand: on the day of delivery;
      2. if sent by post to the correct address: within 72 hours of posting;
      3. if sent by e-mail to the address from which the receiving party has last sent e-mail: within 72 hours if no notice of non-receipt has been received by the sender
    8. In the event of a dispute between the parties to this agreement, then they undertake to attempt to settle the dispute by engaging in good faith with the other in a process of mediation before commencing arbitration or litigation.
    9. So far as the law permits, unless otherwise stated, this agreement does not give any right to any third party.
    10. We are neither liable for any failure or delay in performance of the Event, contract or arrangement which this Ticket enables, nor for any circumstance beyond our reasonable control, including any labour dispute.
    11. The validity, construction and performance of this agreement shall be governed by the laws of the State of Victoria and you agree that any dispute arising from it shall be litigated only in that State.
  12. Privacy Policy
    1. We respect your privacy
      1. Triniq respects your right to privacy and is committed tosafeguarding the privacy of our customers and website visitors. We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). This policy sets out how we collect and treat your personal information.
      2. “Personal information” is information we hold which is identifiable as being aboutyou.
    2. Collection of personal information
      1. Triniq will, from time to time, receive and store personalinformation you enter onto our website, provided to us directly or given to us in other forms.
      2. You may provide basic information such as your name, phone number, addressand email address to enable us to send information, provide updates and process your product or service order. We may collect additional information at other times, including but not limited to, when you provide feedback, when you provide information about your personal or business affairs, change your content or email preference, respond to surveys and/or promotions, provide financial or credit card information, or communicate with our customer support.
      3. Additionally, we may also collect any other information you provide whileinteracting with us.
    3. How we collect your personal information
      1. Triniq collects personal information from you in a variety of ways,including when you interact with us electronically or in person, when you access our website and when we provide our services to you. We may receive personal information from third parties. If we do, we will protect it as set out in this Privacy Policy.
    4. Use of your personal information
      1. Triniq may use personal information collected from you to provideyou with information, updates and our services. We may also make you aware of new and additional products, services and opportunities available to you. We may use your personal information to improve our products and services and better understand your needs.
      2. Triniq may contact you by a variety of measures including, but notlimited to telephone, email, sms or mail.
    5. Disclosure of your personal information
      1. We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this Policy. Personal information is only supplied to a third party when it is required for the delivery of our services.  We may also disclose the information you provide us to the Event Organiser that you purchase tickets from.  When you purchase tickets from an Organiser, you will also be agreeing to the privacy policy set out on their website.
      2. We may from time to time need to disclose personal information to comply with alegal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request.
      3. We may also use your personal information to protect the copyright, trademarks,legal rights, property or safety of Triniq, triniq.com its customers or third parties.
      4. Information that we collect may from time to time be stored, processed in ortransferred between parties located in countries outside of Australia. These may include, but are not limited to Europe, UK, USA, New Zealand and Canada.
      5. If there is a change of control in our business or a sale or transfer of businessassets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances.
      6. By providing us with personal information, you consent to the terms of thisPrivacy Policy and the types of disclosure covered by this Policy. Where we disclose your personal information to third parties, we will request that the third party follow this Policy regarding handling your personal information.
    6. Security of your personal information
      1. Triniq is committed to ensuring that the information you provide tous is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.
      2. The transmission and exchange of information is carried out at your own risk.We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.
    7. Access to your personal information
      1. You may request details of personal information that we hold about you inaccordance with the provisions of the Privacy Act 1988 (Cth). A small administrative fee may be payable for the provision of information. If you would like a copy of the information, which we hold about you or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please email us at support@triniq.com.
      2. We reserve the right to refuse to provide you with information that we hold aboutyou, in certain circumstances set out in the Privacy Act.
    8. Complaints about privacy
      1. If you have any complaints about our privacy practices, please feel free to sendin details of your complaints via email to support@triniq.com. We take complaints very seriously and will respond shortly after receiving written notice of your complaint.
    9. Changes to Privacy Policy
      1. Please be aware that we may change this Privacy Policy in the future. We maymodify this Policy at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our website or notice board. Please check back from time to time to review our Privacy Policy.

      1. When you visit our website: When you come to our website (triniq.com) we may collect certain information such as browser type, operating system, website visited immediately before coming to our site, etc. This information is used in an aggregated manner to analyse how people use our site, such that we can improve our service.
